RpK will not sue NASA over COTS dispute

Ken Schweitzer points me to a story at Space News that reports that Rocketplane-Kistler says it will abide by the GAO decision on its protest over NASA's decision to terminate its COTS agreement. They will not sue NASA if the GAO goes against them: RpK Says It Won’t Take NASA to Court Over COTS Dispute by Brian Berger - Space News/space.com - Dec.26.07 (subscription required). A court action could take years and Congress has directed the agency not to make a new COTS agreement until the RpK protest is resolved. The GAO is expected to make its decision by Feb. 7th.

I wonder if their arguements will include the fact that NASA has susidized the solid rocket booster manufacturing capability for the DOD for decades, even though cheaper options for access to space exist, like OTRAG, Seadragon, Microlaunchers, and Aquarius.
