  1. If John was willing I suspect he could win a lawsuit against NASA for competing against commercial companies with both Morpheus and Mighty Eagle. There is NO reason for NASA to be building their own lander test beds when there are good companies out there doing better for less money.

  2. I agree in principle with that but as far as Armadillo is concerned, I believe Armadillo parted amiably with the Morpheus group after working with them on their first vehicle. As John mentioned in his statement at Quakecon, Armadillo had been making money on such work but he didn’t think it was leading to where he wanted to go. So he discontinued those types of contract jobs and focused instead on building their own vehicles, starting with the Stigs.

Unfortunately, he ran out of his own money doing this. The Stig vehicles were more expensive and time-consuming to build than he expected and the string of failures was unexpected as well. (I assume they made no money from Flight Opps on those launches since they didn’t reach the planned altitude.)

Maybe Masten has a better case against Morpheus and Mighty Eagle. OTOH, they need the Flight Opps contracts.
